What are the Terms of Use for this website?

Acceptable Use:

1.    All copyright is retained by the artist, Michele Sletcher. Images must not be resold or reproduced without the artist’s written permission and approval.
2.    No part of the Site, Services or Content may be uploaded, reproduced, copied, republished, distributed, publicly displayed, transmitted, encoded, licensed, sold or exploited in any way for any commercial purpose whatsoever, without my prior written permission.

Content:

1.    The Site provides general information only.
2.    If you have legally and properly gained access to the Site, you are granted a limited licence to use and access the Site and Content and to download or print a copy of any part of the Content as long as it is solely for your own personal, non-commercial use.
3.    Great care has been taken to accurately show the artwork regarding the colour and size. Differences in browsers, devices and settings may create slight variations between the image and the actual artworks. This is not deemed a fault, and inconsistencies will not be a valid reason for a return.
4.    Any User Content that you post, or feedback given by you to the Site could be viewed by other users on the Site and they may be able to see who posted that User Content. You understand and agree that your User Content will be visible in this way.

Links to Third Party Content:

1.    I am not responsible for any third-party websites or applications that may be contained in the Site as I have no influence or control over their websites, applications or the operator.
2.    If you agree to purchase services and/or goods from third party links or adverts in the Site, then you do so at your own risk, and I will not accept any responsibility for these links.
3.    Affiliate links may be found on the Site which will give me a commission if you make purchases from them.
Sales:
1.    I, the artist, may withdraw any artwork listed for sale on the Site.
2.    If physical goods are purchased from the Site, then my terms and conditions of supply will apply to the sales.

Security of Data:

1.    I will take all possible precautions, that are in my power to do so, to ensure that your order and payment details are secure. I use a secure external payment process and, in the absence of negligence on my part, I cannot be held liable for any loss you may suffer if a third party gains unauthorised access to the data you provided.
2.    The Privacy Policy on this Site sets out the terms by which we process the personal data collected from you, or that you provided. In using the Site, you consent to this processing, and you warrant that all data provided by you is accurate.

Site Management:

1.    I do not guarantee that the Site will be secure or free of viruses.
2.    You have the responsibility to configure your own information technology, platform and computer programs to access the Site safely. You are therefore responsible for using your own virus protection software and keeping it up to date.

Agreement to Terms:

1.    These Terms and Conditions are an agreement between you and Michele Sletcher Art concerning your use of and access to this website (https://michelesletcher.com.au) as well as any related applications on this Site.
2.    The Site provides an online portfolio to show artwork and sell original art, prints, and merchandise as well as related educational products. You may not access or use this Site for any purposes other than it is intended and it may not be used in connection with commercial endeavours except those which are approved or specifically endorsed by me.
3.    I reserve the right to withdraw or modify, permanently or temporarily, this website (or part of it) with or without notice to you, and you confirm I will not be liable to you or any third party for any modifications to or the withdrawal of the website. All orders in process at the time of such changes will, however, be concluded.
4.    I reserve the right to make changes to these conditions and your continued use of this website will be seen as an acceptance of these changes.
5.    You agree that by accessing the Site, you have read, understood and agree to be bound by these Terms and Conditions.
